Private Security Services
All applicants for, and renewals of a guard company license or merchant guard license shall have a background check conducted by the chief of police or his/her designee.
Guard company applicants:
a. The full name, date of birth and address of the local manager of the guard company;
b. A description of the services to be offered;
c. The number of employees;
d. The year, make, model, physical description, license plates and a picture of each vehicle to be used in the course of business;
e. A completed and signed release of information form.
Merchant guard applicant
a. Date of birth of the applicant;
b. A letter of intent to hire from a licensed guard company;
c. One passport sized color photograph;
d. Completed and signed release of information form.
Private Security Services Requirements:
Person(s) qualified to receive or hold a license pursuant to Section 5.32.010 C are as follows:
- A. One who is at least eighteen years of age and is a citizen or legal resident of the United States;
- B. One who has not been convicted of a felony or who has not been dishonorably discharged from any of the armed services of the United States;
- C. One who is not currently required to register as a sex offender in the state or in any other state or territory of the United States;
- D. One who has not been convicted of any act involving illegally using, carrying or possessing a deadly weapon;
- E. One who has not been convicted of any act constituting dishonesty or fraud.
- F. Merchant guards shall provide written proof of employment with any renewal application.
- G. A guard company shall submit written notification of the termination of employment of a merchant guard to the chief of police within ten days of termination.
- H. The applicant must carry an identification card issued by the police department at all times during which he/she is actively engaged in the business.
In addition to the conditions set forth in Chapter 5.04 of the Casper Municipal Code, the city council may refuse to grant, refuse to renew, or may suspend or may revoke any license issued pursuant to this chapter for any one or any combination of the following causes:
1. Fraud or willful misrepresentation in obtaining the license;
2. Violations of any of the terms or provisions of this chapter;
3. If the holder of the license has been adjudged guilty of a crime involving moral turpitude;
4. Any person not qualified pursuant to Section 5.32.030 C..
Vehicle markings.
Every vehicle used by or operated by a guard company in the conduct of business shall display the guard company name in letters at least three inches tall and visible from at least one hundred feet, and the word "Security" in letters at least five inches tall and visible from at least three hundred feet. The words "police" or "officer" shall not be used on any vehicle being operated or used by a guard company.
Definitions:
"Agents and employees" means all persons employed by a guard company, in the conduct of business, except for clerical employees whose duties are confined entirely to stenographic and clerical duties in the business office of the guard company, or other employees not directly engaged in providing protection and preserving the peace.
"Business guard" means an individual who accepts employment from a single employer for the purpose of watching, guarding or otherwise protecting the persons or property of that employer only.
"Merchant guard" means any person who conducts or is engaged in the business of providing protection to persons and property, or preserving the peace in the conduct of any business, except a business guard.
"Guard company" means any merchant patrol company, merchant guard company, armored car company or any other business engaged primarily in the protection of persons and property or in preserving the peace.
