DUI REFUSAL UPDATE
W.S.S. 31-6-102 Test to determine alcoholic or controlled substance content of blood; suspension of license.
If a person under arrest refuses upon the request of a peace officer to submit to a chemical test designated by the agency employing the peace officer as provided in subsection
(a) of this section, none shall be given except in cases where serious bodily injury or death has resulted or upon issuance of a search warrant. A test of the agency's choice may be administered upon issuance of a warrant, including a remotely communicated search warrant, when reasonable under the circumstances and as provided in this subsection.
- A remotely communicated search warrant may be issued upon sworn or affirmed testimony of the peace officer who is not in the physical presence of a judicial officer, provided the judicial officer is satisfied that probable cause exists for the issuance of the warrant.
- All communication between the judicial officer and the peace officer or prosecuting attorney requesting the warrant may be remotely transmitted by voice, image, text or any combination thereof, or by other means and shall be recorded.
- The testimony and content of the warrant shall be recorded by writing or mechanical, magnetic, electronic, photographic storage or by other means.
- Upon approval, the judicial officer may direct a peace officer or the prosecuting attorney requesting a warrant from a remote location to sign the judicial officer's name on a warrant at a remote location.
- A remotely communicated search warrant shall be valid only for purposes specified in this subsection.
CONCEALED WEAPON
6-8-104. Wearing or carrying concealed weapons;
If you are going to be carrying a concealed weapon, you do not need a permit but need to meet most of the same criteria as if you applied for a concealed weapons permit.
If you plan on traveling to outside of Wyoming with a concealed weapon, be aware that only 3 other states besides Wyoming; Alaska, Arizona, Vermont have no permit laws. If you are wanting to carry into other states, you will still need to apply for a permit
Non-Permit Concealed Weapons Candidates:
The person is a U.S. resident.
-- They are at least 21 years old.
-- They do not suffer from a physical infirmity that inhibits safe handling.
-- They are not ineligible to possess a firearm under federal law.
-- They have not been committed to a detention facility because of a felony or misdemeanor controlled substance violation.
-- They do not chronically or habitually use alcohol to an extent that their normal facilities are impaired.
-- They are not adjudicated to be legally incompetent.
-- They have not been committed to a mental institution.
Places where concealed weapons are prohibited:
- Any facility used primarily for law enforcement operations or administration without the written consent of the chief administrator;
- Any detention facility, prison or jail;
- Any courtroom, except that nothing in this section shall preclude a judge from carrying a concealed weapon or determining who will carry a concealed weapon in the courtroom;
- Any meeting of a governmental entity;
- Any meeting of the legislature or a committee thereof;
- Any school, college or professional athletic event not related to firearms;
- Any portion of an establishment licensed to dispense alcoholic liquor and malt beverages for consumption on the premises, which portion of the establishment is primarily devoted to that purpose;
- Any place where persons are assembled for public worship, without the written consent of the chief administrator of that place;
- Any elementary or secondary school facility;
- Any college or university facility without the written consent of the security service of the college or university; or
- Any place where the carrying of firearms is prohibited by federal law or regulation or state law.
